These Terms of Service ("Terms") govern your use of the photo editing service provided at nailretouch.online ("Service"), operated by Volski Dzmitry, registered with the Inspectorate of the Ministry of Taxes and Duties for Pinsk, Republic of Belarus, UNP: BB1238685 from 27.11.25 ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

nailretouch.online is an AI-powered photo editing service designed for nail professionals. The Service allows you to:

Upload nail photos for automated AI editing
Purchase credit packs to process multiple photos
Download edited photos for personal and professional use

2. Account and Authentication

You must sign in using a Google or Apple account to use the Service.
You are responsible for maintaining the security of your account.
Each account is for a single individual. Account sharing is not permitted.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Credits and Pricing

3.1 Credit System

1 credit = 1 photo edit. Each photo you upload for editing consumes one credit.
Credits are purchased in packs. Current pricing is displayed on the Pricing page.
Prices are in US Dollars (USD) and include all applicable fees.

3.2 Free First Edit

Each new account receives one free photo edit.
The free edit is limited to one per person. Attempting to obtain multiple free edits by creating multiple accounts or using other methods constitutes a violation of these Terms and may result in account suspension.

3.3 Credit Expiration

Purchased credits do not expire. They remain in your account until used.

3.4 No Resale

Credits are non-transferable and may not be resold, shared, or distributed to third parties.

4. Payment

Payments are processed by our Merchant of Record payment provider.
By making a purchase, you agree to the payment provider's terms and conditions.
We do not store your payment card information.
All sales are final, subject to the refund policy below.

5. Refund Policy

5.1 Automatic Credit Refund

If a photo edit fails due to a technical error on our side (server error, AI processing failure, delivery failure), the credit used for that edit is automatically refunded to your account.
You do not need to request this — it happens automatically.

5.2 No Refund for Completed Edits

We do not offer refunds or credit returns for successfully completed photo edits, even if you are unsatisfied with the result.
The AI editing process produces automated results. While we strive for high quality, we cannot guarantee that every edit will meet your expectations.

5.3 Monetary Refunds

Refunds of monetary payments (as opposed to credit refunds) are only issued in cases of technical issues that prevent us from delivering the service — for example, if credits cannot be used due to a persistent system failure.

5.4 Quality Issues

If you believe an edit result is significantly below expected quality, you may report it through the Service. We review reported issues but are not obligated to issue refunds or credits for quality complaints.

6. Acceptable Use

You agree not to:

Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Upload photos that you do not have the right to use or edit
Use the Service for bulk automated processing (bots, scripts, or other automated means)
Resell, redistribute, or commercially sublicense access to the Service
Attempt to reverse-engineer, decompile, or extract the AI model or processing pipeline
Circumvent security measures, rate limits, or fraud prevention mechanisms
Create multiple accounts to obtain additional free edits

We reserve the right to suspend or terminate your account without notice if we determine that you have violated these Terms.

7. Intellectual Property

7.1 Your Photos

You retain full ownership and copyright of all photos you upload and the edited results you receive.
By uploading a photo, you grant us a limited, temporary license to process the photo through our editing pipeline and deliver the result to you. This license expires when the photo is deleted from our servers (within 7 days).

7.2 Service Improvement

We may use uploaded photos in aggregated, anonymized form to improve our AI editing technology.
We will never publish, share, or use identifiable photos from your account for marketing or any other purpose without your explicit written consent.

7.3 Our Service

The Service, including its design, code, AI models, and branding, is owned by us and protected by applicable intellectual property laws.
These Terms do not grant you any rights to our trademarks, logos, or other brand features.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties that the Service will be uninterrupted, error-free, or secure
Warranties regarding the quality, accuracy, or reliability of editing results

AI-powered editing produces automated results that may vary in quality depending on the input photo. We do not guarantee specific outcomes.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

Our total liability to you for any claims arising from or related to the Service shall not exceed the total amount you have paid us in the 12 months preceding the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

11. Service Availability

We strive to maintain the Service available at all times, but we do not guarantee uninterrupted access.
We may temporarily suspend the Service for maintenance, updates, or technical reasons without prior notice.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

12. Modifications to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top.
Continued use of the Service after changes constitutes acceptance of the updated Terms.
If we make material changes, we will make reasonable efforts to notify you (for example, by displaying a notice on the website).

13. Governing Law

These Terms are governed by the laws of the Republic of Belarus. Any disputes arising from these Terms shall be resolved in the courts of Belarus, unless otherwise required by applicable consumer protection laws in your jurisdiction.
